The federal appeals court has maintained a prohibition on deploying state troops in the Oregon city, after a latest court ruling.

Appeals Court Agrees to Reconsider Case

The federal appeals court ruled on this week that it would reexamine the legal dispute concerning the president’s authority with an expanded group of eleven justices. The court also vacated a previous decision from a three-judge panel that had supported the federal government.

Ongoing Dispute Over Military Presence

This order represents the latest turn in a long-running court case over whether the former president has the legal right and justification to deploy national guard forces in the city. Approximately two hundred troops have been in limbo since late September when the deployment effort was started in response to ongoing demonstrations.

Conflicting Arguments

The administration has claimed that government employees at the ICE facility in south Portland were under attack, while local authorities maintain that local officers have command of the situation.

In defiance of descriptions of Portland as a conflict zone, locals have been sharing footage of scenic paths and a thriving food scene, and organizing events such as an Emergency Naked Bike Ride against the “militarization of our city”.

Court Proceedings

The Tuesday ruling came after a US district judge in the city enacted two temporary restraining orders this month – one preventing the federalization of the Oregon national guard, and another prohibiting the use of any national guard troops in the state, after attempts to circumvent the initial injunction by mobilizing troops from California.

On the previous day, the ninth circuit panel had put the first ruling on hold – allowing command of 200 Oregon national guard – but the subsequent injunction remained in place, blocking the actual deployment of the troops.

En Banc Review

The latest ruling means the issue will be heard by the full court – with both rulings under consideration simultaneously – by a panel of eleven justices.

“This decision shows that facts are important and that the courts are striving to ensure government responsibility. The constitution restricts the president’s power, and Oregon’s communities cannot be treated as a testing site for expansive government power,” said the state attorney general in a statement.

“The judicial body is sending a clear message: the executive leader cannot dispatch the military into US cities unnecessarily. We will continue protecting state legislation, principles, and autonomy as this legal proceeding moves forward and our fight continues in the courts.”
